CosmosFX.ai provides AI-powered social media marketing automation solutions for real estate professionals and modern marketing teams. We serve individuals as well as Business Clients (''The Services''). Our platform enables users to generate, schedule, and publish social media content automatically across platforms including Facebook, Instagram, LinkedIn, TikTok, X (Twitter), and more — all powered by advanced AI. The Services allow our Business Clients to provide their personnel with access to our platform, making them our End Users. Individuals who independently enroll in our Services (self-served users) or otherwise use our website at cosmosfx.ai are also considered End Users. As an End User, you may need to register with your personal or work email or account before starting to use our Services and configuring your content preferences.

This Policy is a legally binding agreement between you and CosmosFX.ai. If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this agreement. We may change this Privacy Policy at any time and from time to time. Any such change will be effective as of the date it is posted on this page. Your continued use of the Website after the effective date of any changes to this Privacy Policy will be deemed to constitute your acceptance of all such changes.

The Services are not directed to individuals under 18. CosmosFX.ai does not knowingly collect or process personal data from individuals under the age of 18. If you hold parental responsibility over an individual under 18 and believe your child has provided personal data to CosmosFX.ai, please contact us or the relevant Business Client directly.

End User registration — work email and log-in credentials. If you log in using Google or other OAuth features, we may receive your public profile information such as your name, picture, and email address. Payment, Billing & Plan upgrades — credit card information (we only store the last 4 digits and cardholder name). Social media integrations — links to your social media profiles and the analytics received from each social media platform regarding content published through our Services. Contact us / Support — email address, geolocation (by IP address), device type, browser type, and the nature of your request. Log data, usage data, and metadata — system logs (user creation, requests, login status), IP address, operating system, user/device ID, geographic location, and type of device used, along with your activities on our Platform such as actions performed, features used, and errors encountered. Publicly available information — we may collect and process personal data about you from publicly available sources such as social media platforms, online directories, and websites. This may include your name, contact information, professional details, and social media activities, used to personalize our services and communicate relevant offerings. Business Clients: When engaging with us, we collect your representatives' contact details such as name, position, telephone, and email address. Affiliate Program: We collect your name, email address, payment and billing information, traffic and lead generation data, sales information, and commission earnings. You are not legally obligated to provide any of the above personal data. However, without it, we may be unable to provide our Services, in part or in full.

We collect personal data at registration, throughout your use of the Services, and any time you communicate with us. We collect such personal data either as Data Controllers or as Data Processors. If you are operating on behalf of a Business Client, processing of your personal data is subject to our Data Processing Agreement, and we act as Data Processors. Please refer to the relevant Business Client directly, as they are your data controllers.

We use personal data to provide the Services to our Business Clients and End Users. As Data Controllers — we collect, use, and process personal data to establish and manage our relations with you and your related business. We further process personal data for: Customizing and improving the Platform & Services — per our legitimate interests. Monitoring and detecting usage errors and bugs — per our legitimate interests. Payment and billing purposes — as necessary for the performance of our contract. To communicate with you and manage user communication — as necessary for the performance of our contract. To enforce our terms, conditions, and policies — as necessary for the performance of our contract. For analytical purposes — per our legitimate interests. Marketing our Website and Services, or customizing offers to you — per our legitimate interests, and where required by applicable law, based on your consent. To detect and manage abuse or illegal activity — per our legitimate interests. As Data Processors — we collect, use, and process personal data provided through our Platform as instructed, in accordance with our Data Processing Agreement. We may also process personal data for other legitimate purposes, including legal compliance, and to improve our services using anonymized or aggregated data.

Our Platform includes links to external sites and integrations with third-party services (e.g., Facebook, Instagram, LinkedIn, TikTok, X (Twitter), Google Analytics, and Shopify). We are not responsible for the practices employed by external websites linked to or from our Platform. When you use a link to go from our Platform to an external website, our Privacy Policy is no longer in effect. Your browsing and interaction on any external website is subject to that website's own rules and policies. Our Services include integrations with social media platforms that allow you to publish content directly. By using these integrations, we may access data and content according to each platform's respective terms of use and privacy policies. You may revoke these access permissions at any time through the respective platform's security settings.

We shall retain your personal data for the period consistent with the purpose of the collection, as instructed by our Business Clients, and as required to provide our Services. We may also retain your personal data for the time needed to pursue our individual purposes under our legitimate interests, as described above.

With Service Providers — we use a limited number of third-party service providers who act as our sub-processors, including: data storage (cloud services), payment processing, CRM services, image and video management, email and online automation, and analytics services. With Affiliates and Partners — we may share non-personally-identifying data such as statistical or aggregated data with affiliates, subsidiaries, or business partners for legitimate business purposes. Due to Legal Requirements — we may disclose personal data when required to comply with a legal process (such as a court order or subpoena), to mitigate liability in a lawsuit, or to investigate and prevent unauthorized transactions or illegal activities. Due to Restructuring — in the event of a merger, acquisition, or other change of control at CosmosFX.ai, the acquiring entity shall be bound by the provisions of this Privacy Policy.

We may transfer, store, and process personal data on servers located outside of your country of residence. If you do not want your personal data transferred internationally, please do not submit any personal data. When transferring personal data from EEA individuals outside the EEA, we conform with applicable data protection regulations.
